Photography and Videography Terms of Service

We love our customers and want to do an excellent job for you.  Please read this document thoroughly, It is an agreement between us that tells what you should expect from us as well as what we expect from you. Please, if you have any comments or concerns, let us know right away.

Our goal is to have you as a repeat customer and to be a happy customer. We do this by providing excellent products and making your listing owner happy. If you get referrals from satisfied clients because of the photography, we hope you return the favor and use us again.

Cancellation Fees

We charge $75 for shoots cancelled/rescheduled less than 24 hours before the shoot time.

Cancellations due to No Shows

If the photographer is unable to gain access to a property more than 20 minutes past an appointment start time due to The Client or The Client’s representative arriving late or not providing proper access instruction, it will be considered a cancellation. It will be billed at the full rate of the shoot at Realiant Photography’s discretion.  

Cancellations due to weather

Weather happens. If we see poor weather on the day of your shoot, we will reach out and try to reschedule at no charge. However, if we recommend another day, and you still have us come on the original date, and the weather will not cooperate with outdoor shooting, we will have to charge a $75 second visit fee + mileage.

Property Not Ready

If we arrive at a shoot and the property is not ready to shoot, Realiant Photography may charge up to the total amount of the shoot.

On-Site Safety

If our photographer arrives and determines that it is unsafe to shoot the property, they are not allowed to shoot it due to company policy. These reasons can include:

  • Uncontained Animals
  • Structural Issues
  • Biological hazards
  • Illegal drug paraphernalia
  • Angry Renters or Homeowners
  • Firearms in the open
  • Anything else that is potentially physically or mentally dangerous to our photographers.

If the shoot is cancelled because of safety concerns, Realiant Photography may charge up to the total amount of the shoot.

Uncontained Animals

ALL Dogs, no matter what size, must be kenneled or stored in a room/garage that the photographer will not access. Photographers will not be allowed to enter homes with loose dogs. Everyone thinks their dogs won’t bite until one day they do. (Also, loose dogs can knock over costly cameras.)

If a loose animal damages our equipment, the person that books the shoot is responsible for fixing or replacing the equipment.

Rental Properties

The Realtor or homeowner must be present at Tennant-occupied rental properties. 

Help on Site

If the property is not quite ready and you need some help moving some final things, the photographer, at their discretion, may or may not be able to help. However, if they do help, we will charge $75 per hour.

Ready to Shoot

Please get the property completely ready to shoot. The photographer is not responsible for moving, staging, cleaning, etc. While we do try to do some minor things like put toilet seats down, in the end, we are not responsible for that. Typical items we see are:

  • Toilet Seats Up
  • Soap Dispensers, scrubbies, and towels on counters in Bathrooms and Kitchens
  • Messy Beds
  • Personal items in bedrooms/bathrooms
  • Kleenex Boxes
  • Toothbrushes on counters
  • Dirty Towels hanging
  • Dirty Counters
  • Dirty Floors
  • Changing Lightbulbs

The idea is to make other people imagine this could be their house. When you leave personal items, it can take away from that illusion.

Realiant Photography may adjust window coverings, move small items, or turn on/off lights as necessary.  

Turnaround Time

Photos should be ready by the next day at 3:30pm but are usually completed sooner.

Same-day service for photos is available at an additional cost. Photos must be shot before noon. We will usually deliver images before 8 pm. If the images are not ready by 11 pm, then we will refund the same-day additional fee and $25.

Video is usually delivered the next day, although in some cases can be two days out. 

3D tours are usually delivered the next day but sometimes take two days.

Copyright Notice

Realiant Photography is the copyright holder of the image. The copyright of an image is not transferred to any other party unless a specific written agreement is made. Licensing may be obtained for various applications of images. Please contact us for more details. 

Photo Rights

The licensing agreement between the Copyright holder and the listing agent who paid for this service is valid only for the duration the home/property is listed for sale and terminates when the home is no longer for sale or up to one year, whichever comes first. 

If this shoot is for Vacation Rentals or for Commercial, then this agreement is valid in perpetuity.

Images cannot be sold to another agent who takes over an expired or withdrawn listing by the original listing agent. The copyright owner maintains the right to relicense images if they choose to do so. We will encourage the new listing agent to retake the images, but in some rare occasions, that may not be possible. We will reach out to the original listing agent to alert them of a relicensing request.

Failure to pay for the images will result in copyright infringement/violation.  In addition, you will be asked to remove the image from any electronic or printed form of advertisement. Failure to stop using them will result in legal action. 

Photo Rights and Usage for Builders, Stagers, Designers, Homeowners, and others

Builders, stagers, designers, and others who wish to use images taken by our photographer should contact us for specific licensing information. In addition to fees paid to Realiant Photography, a property photography release will need to be obtained from the homeowner. 

Marketing

Both the Realiant Photography and the client are allowed to use the pictures for their marketing purposes.  By ordering a product, the client opts-in to Realiant Photography’s mailing list.  They can opt-out at any time.

Scheduling

Payment

Payment in full is expected before images can be downloaded and used.  A watermarked preview will be available via Realiant Photography’s website for Client approval. Credit cards are preferred, but checks are ok as well.

Our address is 29216 Lakeside Dr, Corvallis, OR 97333. Checks can be made payable to Realiant Photography.

Unethical Retouch

The photographer will not retouch images to disguise known defects and/or physical structures such as wall/floor blemishes, driveway cracks, power lines, power boxes, etc. 

Backup

Final images are backed up by Realiant Photography and are available to be re-delivered until 90-days from delivery date. Photos may no longer be available beyond that period. We recommend that the Client make a local backup of the images to use for the listing duration. Once Client’s contract with the homeowner has ended (property is sold or picked up by another agent), the license expires so the Client should delete their backup at that time. 

Late Fees

Payment is due at the time of delivery. Fees not paid are subject to a 2% interest fee/month and a late fee of $35 after the first month of delinquency.

Final Satisfaction

Shooting real estate is much more of an art than a science. While we have well-trained photographers, sometimes the pictures we deliver are not what you or the homeowner have in mind. Sometimes this is our fault, and other times it is simply different expectations.

We are not responsible if you are unhappy with the artistic composition of the pictures. For example, if the Realtor or homeowner thought a picture should have been from a different angle.  If you have exact requirements, we welcome you to join us at the shoot and direct where you would like the shots from.  Otherwise, we will use our best judgment shooting a plethora of different houses over the years.

We typically shoot the following photos:

  • 2-4 of the Kitchen
  • 2-4 of the Living room
  • 1-3 of the Dining Room
  • 2-3 of Primary Bedroom
  • 1-2 of each bathroom
  • 1 Walk In closet
  • 1-2 Regular bedrooms
  • 1 of the Entryway
  • 1-2 for each additional room
  • 4-8 Exterior Photos
 

If we miss a major room (Kitchen, Living Room, Master Bedroom, Dining Room), we will come back to reshoot at no cost to you.

If we miss any other rooms, we may come back at our cost or ask you to take a picture with the wide-angle lens on your cell phone (we will give you instructions). We will then edit this to look like our photos. For each of these, we will offer a $10 discount.

We find that sometimes homeowners who are very attached to their homes tend to have particular things they would like to see that are impossible for us to know in advance. Especially if they built the home. If you, as a Realtor, sense that your Client might be high maintenance, please get a list of shots from them. They are also welcome to be on-site to confirm the shots with us as we shoot them. We want them to be happy, so they will refer you to others!

Custom Editing

If there are items in the shot that you want to be removed, we can usually “Photoshop” them out. If they exist because of something we did (Left a water bottom on a table), we will do that at no cost. Anything else will be charged at the rate of $75/hr and will be done only if you request it.

Errors and Omissions

If we create a rough outline of a lot’s boundary on the imagery, we are not responsible for errors in the property boundary.  If you need an accurate property boundary, you need to hire a licensed surveyor.

Indemnification

Client will indemnify and defend Video/Photographer against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of the creation or any use of the Photos or materials furnished by Client. It is the Client’s responsibility to obtain the necessary model or property releases and ensure they are in full effect and force. 

Delivery

Photographer may select delivery of photographs in JPEG at a resolution determined to be suitable for the Photos as licensed. It is the Client’s responsibility to verify that the Photos are suitable for reproduction and that if the Photos are not deemed suitable, to notify the Photographer within 7 business days. 

No Exclusivity

This Agreement does not create an exclusive relationship between the parties; Client is free to engage others to perform services of the same or similar nature to those provided by Photographer, and Photographer shall be entitled to offer and provide design services to others, solicit other clients, and otherwise advertise the services offered by Photographer.

General Law/Arbitration

This Agreement sets forth the entire understanding and agreement of the parties, and supersedes any and all prior agreements between
the parties. This Agreement shall be governed and interpreted and enforced in accordance with the laws of Oregon. Any claim or litigation rising out of this Agreement or its performance may be maintained only in courts physically located in Benton County, Oregon and the parties hereby consent to the personal jurisdiction of such courts. In the event of any litigation arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its attorneys’ fees incurred in the litigation. If parties are unable to resolve the dispute by negotiation, either party may start mediation and/or binding arbitration in a forum mutually agreed to by the parties. 

Severability

If one or more of the provisions contained in the Agreement is found to be invalid, illegal, or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable. 

Waiver

No action of either party, other than express written waiver, may be construed to waive any provision of this Agreement, and a single or partial exercise by either party of any such rights or remedies will not preclude further exercise of other rights or remedy. 

Termination

By Either Party for Breach of Agreement. Either party shall have the right to terminate this Agreement in the event of the other party’s material breach of any obligation, representation, or warranty herein, upon giving the breaching party 15 days’ written notice and the right to cure such breach.
